SparkleBot – WhatsApp Business Terms & Conditions

SparkleBot is a Meta based verified messaging service, offered as a product of SMSGATEWAYHUB TECHNOLOGIES PVT LTD. By using SparkleBot, you agree to the following Terms & Conditions. These terms are designed to clearly explain our portal responsibilities, limitations, and Meta-related dependencies in a simple and transparent manner.

1. Service Nature & Meta Dependency

SparkleBot operates entirely on Meta’s WhatsApp Business Platform. All key processes—including business verification, display name approval, number approval, template approval, message delivery, and account status—are controlled and governed by Meta.

SparkleBot and SMSGATEWAYHUB TECHNOLOGIES PVT LTD act only as a technology enabler and do not have control over Meta’s internal review, approval, rejection, restriction, or ban decisions.

2. Restricted & Sensitive Industries

Meta has strict policies for certain industries. Accounts related to the following (including but not limited to) may face rejection, restriction, or permanent ban by Meta:

• Medical / Pharma / Healthcare

• Legal & Law Firms

• Government, Police, or Public Authorities

• Political Parties & Election Campaigns

• Stock Market, Trading, Crypto, or Investment Advisory

• Loans, Credit, Finance, or Recovery Services

• Gambling, Betting, or any unethical or policy-violating activity

Even if such businesses intend to send only Utility messages or OTPs, Meta may still restrict or ban the account based on company name, website content, or overall profile review.

👉 In all such cases, SparkleBot and SMSGATEWAYHUB TECHNOLOGIES PVT LTD hold no responsibility for approvals, rejections, restrictions, or bans, as these decisions are taken solely by Meta.

3. Subscription, Trial & Onboarding Timeline

• SparkleBot offers subscription-based plans, including a 14-day trial plan, similar to other Meta-approved WhatsApp service providers.

• Subscription charges cover platform usage, onboarding support, number registration, and WhatsApp configuration.

• WhatsApp number registration is typically completed within 30–60 minutes, subject to successful document and website verification.

• Display Name approval is applied immediately after onboarding.

• In approximately 98% of cases, Meta verifies business profiles within 24–48 working hours.

• SparkleBot provides a 14-day trial plan for testing purposes.

However, if Meta identifies any issue with documents, website content, or business category, the status may show “In Review” for an extended period or result in rejection.

⚠️ SparkleBot cannot manually influence or expedite Meta’s approval timelines.

4. No Refund Policy (Meta-Dependent Cases)

Any issues related to Meta approvals—including but not limited to: - Business verification rejection - Display Name rejection - Account restriction or ban - Delays due to Meta review are completely dependent on Meta’s internal policies.

👉 No refunds will be provided for delays, rejections, or restrictions arising from Meta-dependent processes.

5. Data Security & Privacy

• Message templates are approved both at the Facebook Business Profile level and Meta’s backend systems.

• Message delivery reports, webhook callbacks, and status updates are generated directly by Meta.

• SparkleBot ensures that no customer data is shared, misused, or accessed unlawfullyfrom our end.

We follow industry-standard security practices to ensure data safety within our platform.

6. Client Responsibilities

Clients are responsible for: - Providing accurate and compliant business documents - Ensuring website content follows Meta policies - Using WhatsApp services only for approved use cases - Complying with all local laws and Meta platform rules

Any misuse, misleading content, or policy violation may result in immediate restriction or termination by Meta.

7. Relationship Clarification

SparkleBot is a verified WhatsApp Business solution and a product of SMSGATEWAYHUB TECHNOLOGIES PVT LTD. Meta (WhatsApp) is an independent platform provider. SparkleBot does not represent Meta and cannot override Meta’s decisions.

8. Acceptance of Terms

By using SparkleBot services, you acknowledge that: - You understand Meta’s role and control in the approval process - You accept the risks associated with Meta-based dependencies - You agree to these Terms & Conditions in full

9. Applied From

These Terms and Conditions are effective as of 1st March 2024.

10. Changes to Terms and Conditions

We reserve the right to modify or revise these Terms and Conditions at any time, and you agree to be bound by such modifications or revisions. You are responsible for reviewing these Terms and Conditions periodically to ensure that you are aware of any changes.
